1. About us and these terms
Kent Vehicle Programming provides mobile vehicle diagnostics, ECU and TCU remapping, software programming and custom coding services. You can contact us at Hello@kentvehicleprogramming.co.uk or on 07508 555838.
These terms form part of the agreement when we accept a booking. A quote request or initial enquiry does not by itself create a contract. Any written quotation, booking confirmation or job-specific conditions supplied to you also form part of the agreement. If there is a conflict, the job-specific written terms take priority.
2. Quotes, prices and payment
Quotes are based on the information you provide, including the registration, vehicle specification, software version, reported symptoms, location and requested work. We may revise or withdraw a quote if the vehicle, condition, access or requested work is materially different when we attend.
Prices will be confirmed before chargeable work begins. Unless agreed otherwise, payment is due when the work is completed. We may require a deposit, diagnostic fee, travel charge or payment in advance for specially ordered software, files or parts. Any such charge will be explained before the booking is confirmed.
3. Your authority and responsibilities
You confirm that you own the vehicle or have the owner’s authority to approve the work. You must give accurate information and disclose known faults, previous remaps, tuning boxes, coding changes, immobiliser or security work, accident damage, water damage, electrical issues, weak batteries, mechanical defects and any relevant repair history.
You are responsible for providing lawful access, permission to work at the location, safe working space and any required parking, congestion or access arrangements. We may refuse or stop work if conditions are unsafe, access is unsuitable or the vehicle differs materially from the information supplied.
4. Vehicle condition and diagnostic limitations
Diagnostic trouble codes and scan data are evidence used to investigate a fault; they do not always identify a failed component by themselves. Some faults are intermittent, mechanical, wiring-related or dependent on conditions that may not be present during the appointment. Further testing, dismantling or workshop investigation may be required.
A diagnostic fee covers the time, equipment and professional assessment supplied and does not guarantee that a fault can be conclusively identified or repaired during one visit.
5. Programming and remapping risks
Vehicle programming involves communicating with electronic control modules and changing or reinstalling software. Even when carried out with reasonable care and suitable equipment, programming can reveal pre-existing defects or be interrupted by weak batteries, unstable power supplies, damaged wiring, failing modules, prior modifications, corrupted software, communication faults or manufacturer security restrictions.
Where reasonably possible, we will assess the vehicle, use appropriate battery support and retain an original software read or recovery data. Not every control unit supports a complete backup or a guaranteed restoration procedure.
By authorising programming or remapping, you accept the normal technical risks inherent in that work. This does not remove our responsibility to perform the service with reasonable care and skill.
6. Mechanical wear and suitability
Remapping can increase torque, power and load on the engine, turbocharger, clutch, gearbox, driveshafts, cooling system, emissions equipment and other components. A calibration does not repair existing wear, poor maintenance or an underlying mechanical defect. Components that are already worn or operating close to their limit may fail sooner after increased performance is used.
We may recommend servicing, repairs or further inspection before tuning. We may refuse to remap a vehicle that appears unsuitable, unsafe, poorly maintained or affected by unresolved faults.
7. Performance and fuel-economy results
Any performance, torque or fuel-economy figures are estimates rather than guarantees unless we expressly agree otherwise in writing. Results vary with vehicle condition, fuel quality, software version, load, driving style, route, weather, tyres, maintenance and other factors. Fuel-economy improvements normally depend on the driver using the additional torque without increasing speed or acceleration.
8. Manufacturer and third-party warranties
Programming, remapping or coding may affect or invalidate all or part of a manufacturer, dealer, finance, lease, breakdown or third-party warranty. A manufacturer or warranty provider may detect software changes even if the vehicle is later returned to standard.
You are responsible for checking the terms of any warranty, finance or lease agreement and obtaining any required permission before authorising work. We cannot guarantee how a manufacturer, dealer, insurer, finance provider or warranty company will treat a modification or subsequent claim.
9. Insurance, finance and legal declarations
You are responsible for notifying your insurer and any finance, lease, fleet or warranty provider of relevant modifications. Failure to declare a modification may affect insurance cover or contractual rights. You must not ask us to describe modified software as standard or conceal work from another party.
10. Road use, emissions and safety systems
You are responsible for ensuring the vehicle remains roadworthy, insured and lawful for its intended use. Services that unlawfully defeat or disable manufacturer emissions-control or safety systems are not supplied for vehicles intended for use on UK public roads.
ADBLUE, SCR, DPF, airbag and SRS enquiries may require diagnosis and repair. We may decline any work where the intended use, legality, ownership or authority is unclear.
11. Coding and feature availability
Coding options vary by model, module, software version, equipment and market specification. A feature described online or available on another vehicle may not be supported on your vehicle. Some manufacturer software updates, replacement modules or dealer actions can reset or overwrite coding.
12. Cancellations, missed appointments and delays
Please give as much notice as possible if you need to cancel or rearrange. We may charge reasonable, disclosed costs for non-refundable files or parts, reserved time, travel already undertaken, failed access, or appointments cancelled at short notice. Any applicable fee will be confirmed before booking or before the cost is incurred.
Arrival times are estimates because mobile work is affected by traffic, weather, earlier jobs and technical issues. We will contact you if a material delay arises. We are not responsible for delay caused by events outside our reasonable control, but this does not affect your statutory rights.
13. Consumer cancellation rights
If you are a consumer and the contract is made online, by telephone or away from our business premises, you may have a statutory 14-day right to cancel from the day after the contract is made, unless an exception applies.
If you ask us to begin work during that cancellation period, you expressly request early performance. If you then cancel before the service is complete, you may have to pay a proportionate amount for work supplied up to cancellation. Once a requested service has been fully performed, your cancellation right for that service may end. Your cancellation rights for faulty or improperly performed services are separate and are not affected.
To cancel, contact us clearly by email or telephone using the details above. We will confirm any applicable refund or charge.
14. Reverting software and aftercare
If an agreed software service includes a return-to-standard option, it applies only where the original file or a suitable standard file remains available and the control unit is still accessible and operational. Labour, travel, third-party files, dealer updates, replacement modules and mechanical repairs are not included unless expressly stated.
You must contact us promptly if you believe an issue is connected with our work and allow us a reasonable opportunity to inspect and, where appropriate, repeat or correct the service before arranging third-party work, except where urgent action is reasonably required to prevent further damage or ensure safety.
15. Liability
We will provide our services with reasonable care and skill. Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.
We are responsible for foreseeable direct loss or damage caused by our breach of contract or failure to use reasonable care and skill. We are not responsible for loss or damage that is not caused by our breach, was not reasonably foreseeable when the contract was made, or results from:
- a pre-existing, hidden or inherent vehicle defect;
- incorrect or incomplete information supplied by you;
- weak batteries, defective wiring, failing control modules or prior unauthorised software changes that were not reasonably detectable beforehand;
- continued use of a vehicle after a warning, fault or instruction to stop driving;
- work, updates, parts or alterations carried out by you or a third party after our service; or
- failure to follow maintenance, fuel, inspection or aftercare instructions.
We do not exclude liability simply because damage occurs during programming. Each issue will be assessed on its facts, including the vehicle’s prior condition and whether the service was performed with reasonable care and skill.
If you are booking wholly for business purposes, we will not be liable for loss of profit, revenue, contracts, business opportunity, goodwill or indirect business loss, except where such liability cannot lawfully be limited.
16. Complaints
Please contact us as soon as possible at Hello@kentvehicleprogramming.co.uk or 07508 555838, explaining the booking, vehicle, issue and outcome sought. We will review the available records and respond within a reasonable time.
17. Personal data
We handle personal information in accordance with our privacy notice. Vehicle identifiers, diagnostic reports and software files may be retained where reasonably necessary for service records, aftercare, security, dispute resolution and legal obligations.
18. General
If part of these terms is found invalid or unenforceable, the remaining terms continue to apply. A delay in enforcing a right does not waive it. These terms are governed by the law of England and Wales. Consumers may bring proceedings in the courts available to them under applicable law.
